Анотація

Стаття присвячена дослідженню актуальних проблем кваліфікації співучасті у кримінальних правопорушеннях зі спеціальним суб’єктом. The
Автори статті звертають особливу увагу на відсутність узгодженої точки зору в науці кримінального права щодо визнання загальних і спеціальних суб’єктів співучастю у вчиненні кримінального правопорушення та необхідність розробки правил кваліфікації кримінальних правопорушень з спеціальний суб'єкт у співучасті. Основні доктринальні підходи до кваліфікації співучасті генерала
розглядаються суб'єкт у кримінальних правопорушеннях зі спеціальним суб'єктом. Встановлено, що правила кваліфікації дій співучасників потребують диференційованого підходу та залежать від ознак спеціального суб’єкта та ознак інших ознак кримінального правопорушення.
