СТАН НАУКОВОЇ РОЗРОБЛЕНОСТІ ПРОБЛЕМИ КОМУНІКАЦІЇ ПОТЕРПІЛОГО В КРИМІНАЛЬНОМУ ПРОЦЕСУВАННІ ПРАВ В УКРАЇНІ

Анотація
У статті досліджено стан наукової розробки проблеми правозахисної комунікації потерпілого у злочинця провадження України. Згідно зі статтею 2 КПК України основним завданням кримінального провадження та суть кримінального процесу є захист потерпілого, його прав, свобод і законних інтересів. Під правом потерпілого на правозахисне спілкування розуміється передбачена кримінально-процесуальним законом можливість потерпілого, його представника, законного представника чи правонаступника отримувати інформацію про кримінальне провадження, обмінюватися інформацією про стан кримінального провадження, впливати на нього. кримінальне провадження з метою захисту та поновлення порушених прав, свобод і законних інтересів відповідного учасника кримінального провадження. Проблема правозахисної комунікації потерпілого покликана ґрунтовно та цілісно інтегрувати численні аспекти, пов’язані із захистом прав та законних інтересів потерпілого. Він також прагне спрямувати нові імпульси наукових досліджень у сфері захисту прав потерпілих на вдосконалення механізму реалізації відповідних прав у змагальному кримінальному процесі на основі жертвоцентричного підходу. У статті розглядаються питання, які ще не порушувалися в наукових працях, але є суттєвими для теорії кримінального процесу та правоохоронної діяльності. У статті наголошується на актуальності обґрунтування та дослідження права потерпілого на процесуальне спілкування та поняття правозахисного спілкування потерпілого у кримінальному провадженні. Він також висвітлює комунікативну рівність як фундаментальну цінність, яка пронизує норми кримінального права та процесу, кримінально-процесуальну діяльність потерпілого, а також комунікаційні гарантії та бар’єри, які сприяють або заважають останній.
