Анотація

У статті розглядаються правові та політичні наративи щодо приєднання України до Римського статуту Міжнародного кримінального суду. Україна підписала його у 2000 році, але не ратифікувала досі (квітень 2023 року) через політичну напруженість та правові (законодавчі) розбіжності. Спектр застосованих методів у цьому дослідженні є широким. Основними методами дослідження, використаними в цій статті для виокремлення суттєвих перешкод щодо повноцінної участі України в діяльності Міжнародного кримінального суду, є описовий та якісно-порівняльний.


 


У статті автор окреслює важливість для кожної демократичної країни (яка гарантує права людини, верховенство права та справедливість) бути державою-учасницею Міжнародного кримінального суду, аналізує сильні та слабкі сторони, виклики та загрози, пов'язані з його ратифікацією. Ратифікація має відродити конституційні цінності (демократію, верховенство права) та людську гідність в Україні. Є підстави для висновку, що ініціатива створення окремого міжнародного трибуналу має відображати застосування принципу верховенства права де-факто і де-юре. Справедливість має восторжествувати, і йдеться не лише про сприйнятливі гасла українських лідерів, звернені до наших партнерів, але й про масові та ефективні юридичні, законодавчі та дипломатичні дії. Йдеться про щоденну рутинну роботу з розслідування воєнних злочинів для виявлення тих, хто ймовірно скоїв масові злочини (тобто геноцид, злочини проти людяності, воєнні злочини та злочини агресії) в Україні з 2014 року, особливо після повномасштабного вторгнення у 2022 році, і всі винні у міжнародних злочинах, скоєних в Україні, мають бути притягнуті до кримінальної відповідальності.
