ПРАВОВЕ РЕГУЛЮВАННЯ ІНШИХ ФОРМ БЕЗПОСЕРЕДНЬОЇ ДЕМОКРАТІЇ В АЗЕРБАЙДЖАНСЬКІЙ РЕСПУБЛІЦІ: ПОТОЧНА СИТУАЦІЯ, ПРОБЛЕМИ ТА ШЛЯХИ ЇХ ВИРІШЕННЯ

Анотація
Свобода зібрань має кілька історичних коренів. У давні часи свобода зібрань була тісно пов'язана з правом на петиції, тобто особистий інтерес громадян і суспільне благо були спрямовані проти монарха. У консультативних формах прямої демократії використання окремих інститутів свободи зібрань у суспільно-політичних процесах є дуже важливим. Так, для того, щоб люди могли реалізувати свої публічні права, вони можуть ефективно впливати на політичну владу через інститут свободи зібрань, в консультативній формі. Це є одним з основних засобів збалансування діяльності політичної влади.
Свобода зібрань забезпечується правовими гарантіями та відповідними обмеженнями, передбаченими Конституцією та міжнародними угодами. Основним завданням держави є вжиття належних заходів для проведення мирних і вільних зібрань без зброї. Принцип рівності не може бути порушений при здійсненні цього права на свободу. "Зібрання" означає тимчасове зібрання кількох людей у громадських місцях з політичною метою, яке може відбуватися у формі публічних заходів, мітингів, пікетів, наметових містечок, демонстрацій, вуличних походів тощо.
Особа або група осіб, які організовують різні форми реалізації свободи мирних зібрань, повинні заздалегідь отримати офіційне погодження від органу виконавчої влади або повідомити його про відповідний захід. Попередження має бути обґрунтоване організаторами та пояснювати його мету. При проведенні цих масових заходів слід визнати волевиявлення народу головним чинником і неухильно дотримуватися вимог закону. Динаміка розвитку консультативних форм демократії безпосередньо залежить від рівня демократичної державності цих демократичних держав. Одними з головних чинників тут є наявність громадянської солідарності та ліберальної законодавчої системи держави.
У застосуванні свободи вільних зібрань, вираження думки і волі народу та його частини, як одного із засобів впливу на політичну владу, ці процеси відбуваються в тому ж напрямку, що і процес демократичного розвитку держави. Ці політичні інститути є однією з можливостей народу контролювати демократичні процеси та постійно розвивати їх.
