Тимчасовий захист в Європейському Союзі: правовий аналіз

Анотація
Повномасштабне вторгнення росії в Україну у 2022 році призвело до масової міграції населення до країн Європейського Союзу. Це, в свою чергу, актуалізувало питання правового регулювання тимчасового захисту для таких осіб. Аналіз цієї проблематики є необхідним для розуміння механізмів надання допомоги, визначення прав та обов'язків користувачів тимчасового захисту, а також для оцінки ефективності європейського законодавства в умовах масштабної гуманітарної кризи.
Метою статті є проведення комплексного дослідження правового регулювання тимчасового захисту в Європейському Союзі, зокрема, аналіз відповідних норм європейського та національного законодавства країн-членів ЄС, а також практики їх застосування в контексті української кризи. Для досягнення мети дослідження використано такі методи, як метод юридичного аналізу, за допомогою якого було проведено детальний аналіз Директиви 2001/55/ЄС про тимчасовий захист та інших релевантних нормативних документів. За допомогою методу порівняльного аналізу було здійснено порівняння національного законодавства різних країн-членів ЄС для виявлення спільних рис та відмінностей у підходах до надання тимчасового захисту.
Результати дослідження можуть бути використані для подальшого вивчення таких питань, як довгострокові наслідки тимчасового захисту для міграційної політики ЄС, інтеграція користувачів тимчасового захисту у ринок праці країн-членів ЄС, а також проблеми повернення користувачів тимчасового захисту до країн походження після завершення війни.
