Додаткові гарантії дотримання прав і свобод спеціально визначених суб'єктів під час проведення негласних слідчих (розшукових) дій

Анотація
У статті розглядаються додаткові гарантії, які надаються спеціально визначеним суб’єктам — адвокатам, журналістам, медичним працівникам, посадовим особам — під час проведення негласних слідчих (розшукових) дій. Ці суб’єкти займають посади, які вимагають посиленого захисту через делікатний характер їхніх ролей і обов’язків. Дослідження аналізує правові рамки, як національні, так і міжнародні, спрямовані на захист прав і свобод цих осіб під час прихованого спостереження, обшуків чи інших слідчих дій. Він наголошує на необхідності суворих механізмів контролю, правових гарантій і процедурної прозорості, щоб запобігти зловживанням і забезпечити, щоб будь-яке посягання на права було виправданим, пропорційним і законним. Стаття також визначає прогалини в існуючих нормах і пропонує покращення для кращого захисту спеціально визначених суб’єктів, таким чином збалансовуючи потреби правоохоронних органів із збереженням основних прав людини.
