Анотація

У статті висвітлюються особливості матеріально-правових принципів міжнародного права як правової основи боротьби з незаконним обігом об'єктів культурної спадщини. З цією метою проведено порівняльний аналіз міжнародно-правових документів та законодавства Азербайджанської Республіки. Досліджено імплементацію характерних принципів міжнародного права та її особливості в процесі правотворчості та правозастосування у сфері боротьби з незаконним обігом об'єктів культурної спадщини. Ці принципи, покладені в основу правотворчості, оцінюються у двох напрямах: 1) на основі основоположних принципів, які виступають матеріальним джерелом, створюються інші спеціальні або галузеві принципи міжнародного права та норми міжнародних договорів; 2) національна нормотворча діяльність Азербайджанської Республіки ґрунтується на основних принципах міжнародного права. У цьому контексті основні принципи міжнародного права визначаються як змістовний елемент загального порядку (ordre public) цієї країни.
