ПРІОРИТЕТНІ НАПРЯМКИ ЗАБЕЗПЕЧЕННЯ ЖИТЛОМ ГРОМАДЯН В УМОВАХ ВІЙНИ ТА ПОВОЄННОЇ ТРАНСФОРМАЦІЇ

Анотація
Питання надання громадянам мінімальних гарантій та забезпечення дотримання соціально-економічних прав людини набуває особливої актуальності в умовах війни та післявоєнної трансформації. Такі права, як свобода пересування, пенсійне та соціальне забезпечення, працевлаштування, освіта, достатній життєвий рівень, житло, рівність та захист від дискримінації, серед багатьох інших, стали критично вразливими. Війна лише посилила тягар і відповідальність держави за впровадження ефективних заходів, необхідних для досягнення мети захисту цих прав. Основна увага приділяється житловому сектору в Україні, який тривалий час перебуває у кризовому стані. Стверджується, що реалізація державою правових і практичних заходів, необхідних для ефективного захисту права на житло, відбулася лише частково через збройний конфлікт, який розгорнувся у 2014 р. на сході України, що призвів до масового внутрішнього переміщення громадян України в межах країни. У статті встановлено, що повномасштабні військові дії ще більше загострили житлову проблему, з якою стикаються громадяни. У складних умовах вплив війни має позначатися не лише на базових потребах окремих громадян, а й на ефективному функціонуванні всього державного механізму. Війна не повинна призводити до зниження рівня захисту прав, визнаних Європейською соціальною хартією, як в Україні, так і за її межами. Моніторинг відновлення зруйнованого або пошкодженого житла на рівні громад, оцінка житлових потреб громадян та вирішення інших проблем потребують негайної уваги на державному рівні. У статті стверджується, що основна увага держави має бути зосереджена на створенні нових доктринальних підходів до забезпечення житлом, що ґрунтуються на міжнародних стандартах прав людини та враховують кращі науково обґрунтовані практики і досвід європейських країн. Підкреслюється, що сучасні житлові потреби диверсифікувалися, і все більшої актуальності набуває тимчасове кризове житло на період відновлення житла або пошук орендованого житла.
