«Право на життя» та «Право на гідність» у рамках захисту прав людини: вплив паліативної допомоги та медицини на реалізацію

Анотація
У статті досліджено вплив паліативної допомоги та медицини на реалізацію основних прав людини, зокрема «права на життя» та «права на гідність», у рамках правового захисту. Проаналізовано правове регулювання паліативної допомоги на міжнародному та національному рівнях, підкреслено її роль у забезпеченні гуманної та недискримінаційної медичної допомоги. Дослідження розглядає взаємозв’язок між доступністю паліативної допомоги та позитивними зобов’язаннями держави щодо охорони здоров’я, а також виклики, пов’язані з гарантуванням гідного завершення життя відповідно до стандартів прав людини. Особливу увагу приділено практиці Європейського суду з прав людини, яка дає розширене тлумачення права на гідність у контексті охорони здоров’я.
