“Right to Life” and “Right to Dignity” within the framework of human rights protection: Influence of palliative care and medicine on the fulfillment

Abstract
The article explores the impact of palliative care and medicine on the realization of fundamental human rights, particularly the «right to life» and the «right to dignity,» within the framework of legal protection. It analyzes the legal regulation of palliative care at the international and national levels, emphasizing its role in ensuring humane and non-discriminatory healthcare. The study examines the interrelation between the availability of palliative care and the state’s positive obligations to protect health, as well as the challenges in guaranteeing a dignified end of life in compliance with human rights standards. Special attention is given to the case law of the European Court of Human Rights, which provides an extended interpretation of the right to dignity in the context of healthcare.
