Правові аспекти екологічного тероризму в контексті війни в Україні: нові виклики глобальній безпеці

Анотація
У статті наведено комплексний теоретичний та правовий аналіз феномену екологічного тероризму в контексті повномасштабної збройної агресії Російської Федерації проти України. Особлива увага приділяється правовій природі цього явища, його конкретним проявам під час війни та проблемам класифікації таких діянь згідно з національним та міжнародним правом. У дослідженні окреслено приклади навмисного руйнування критичної екологічної інфраструктури, такі як вибух Каховської ГЕС, масове забруднення навколишнього середовища та підпали лісів, як інструментів терористичного впливу. У статті виявлено правові прогалини в українському законодавстві щодо криміналізації екоциду як форми тероризму та наголошено на необхідності його гармонізації з міжнародним правом. Автор пропонує правову класифікацію екологічного тероризму, виділяє його ключові форми та окреслює ефективні контрзаходи. Стверджується, що екологічний тероризм у контексті сучасної війни перетворюється на глобальну загрозу міжнародній безпеці, екосистемам та гуманітарному правопорядку, а тому вимагає чіткої правової відповіді на всіх рівнях.
