КОНСТИТУЦІЙНІ ЗМІНИ: ПОРІВНЯЛЬНИЙ (ПЕРЕ)ПОГЛЯД У СУЧАСНОМУ КОНСТИТУЦІОНАЛІЗМІ

Анотація
Ця стаття проливає світло на існуючі політичні, правові та законодавчі моделі внесення змін до конституції в окремих європейських країнах. Основна увага приділяється (не)успішним інструментам, механізмам і процедурам внесення змін до конституції (ініціатива, розробка, прийняття та імплементація важливих політичних, правових і законодавчих рішень парламентом, а також схвалення конституційних змін на всенародному референдумі). Ми дотримуємося тематичної та методологічної основи, що базується на теоретичному дослідженні та концептуалізації "вічних" положень (конституційних положень, що не підлягають зміні). У статті також представлено ретельний аналіз відмінностей у процедурі внесення змін до конституції в окремих країнах (Італії, Польщі та Україні) під час оголошення "надзвичайного стану" або інших надзвичайних режимів. Крім того, в ньому розглядаються результати конституційних референдумів, спрямованих на модифікацію або зміну Конституції.
Це дослідження має на меті з'ясувати, чи залежить процес внесення змін до конституції (модифікація, зміна, скасування чи доповнення) від форми правління в конкретній країні. Чи він залежить від рівня закріплення її конституції? Чи це просто дієвий (успішний) механізм і бездоганний первинний політичний інструмент, який використовується проурядовою правлячою більшістю (або іноді парламентською опозицією) для того, щоб "виграти гру" або стати реальною зміною правил гри на вимогу громадян? Належним чином проведені конституційні зміни можуть забезпечити простір для публічних та інституційних дебатів, сприяти легітимності Конституції, а також розвивати і консолідувати демократичні конституційні традиції з плином часу. Цього можна досягти, забезпечивши, щоб інструменти, правила, механізми і процедури конституційних змін (зміни, модифікації, скасування) були відкритими для тлумачення і суперечок. Навпаки, якщо їх застосовувати поспіхом або без належного демократичного дискурсу (і підтримки громадянського суспільства), це може підірвати внутрішньополітичну стабільність у країні і, зрештою, легітимність конституції.
Цілком ймовірно, що закінчення війни в Україні, яка триває з 2014 року, і повномасштабне вторгнення Росії 24 лютого 2022 року призведе до зміни парадигми конституціоналізму. Можливо, будуть прийняті нові або переглянуті існуючі конституції, які відображатимуть післявоєнний світовий порядок, основні цінності та рівень розвитку держави і суспільства, де панує верховенство права.
